🚨 Friendly heads-up for my real estate friends 🚨

Starting March 1, 2026, new FinCEN BOI reporting requirements may impact CASH real estate deals when an LLC or entity is involved — even contracts you’re already working on if they close after that date.

If you’re seeing:
• cash buyers or sellers that aren't individuals
• LLCs or newly formed entities
• builder or portfolio transactions

This isn’t title insurance stuff — it’s a federal reporting requirement — and catching it early can help keep closings smooth.

Whether I’m working with agents in Indiana or Illinois, I’ve noticed the same three "hidden" items derail closings at the 11th hour. The pros catch these at the listing appointment; the rest wait for the title commitment.

The 'Pre-Flight' Title Framework:

1️⃣ The "Zombie" Mortgage: An old loan was paid off, but the lender never recorded the release. These take weeks of "detective work" to clear. 2️⃣ The Trust & Deed Audit: Whether it’s an Illinois Land Trust or an Indiana Family Trust, get the docs early. Confirming exactly who has the power to sign prevents a "missing signature" crisis later. 3️⃣ The HOA/Tax "Gotcha": From unrecorded "special assessments" to unpaid municipal liens, these are the silent killers of a smooth closing.

Because a luxury closing experience starts with the questions you ask before the sign even goes in the yard.
