🏡 with Title Write! 📑 Title Commitment vs. Title Policy: Why the Difference Matters.

A recent federal court ruling highlights an important reminder for title professionals: The coverage outlined in a title commitment may not be the same as the coverage provided in the final policy.

In Price v. Chicago Title Insurance, the Eleventh Circuit ruled that under Georgia law, once a title insurance policy is issued, it replaces the earlier commitment. This means the final policy determines coverage, even if the original commitment contained fewer exclusions.

💡 The takeaway? Don't assume the coverage outlined in a title commitment carries over unchanged! Carefully compare the final policy against the commitment, paying close attention to exclusions, exceptions, and any changes that could impact your client's protection. Identifying discrepancies early can help prevent unexpected coverage issues down the road.

🏡 : Moving property into an LLC? Don’t assume your existing title policy moves with it. 🏢

🗽 A recent New York case highlighted an important distinction: a title policy issued to individual property owners may not continue to protect the property after it is transferred into an LLC, even when those same individuals own the LLC.

📄 Because an LLC is a separate legal entity, property owners and investors should review their title coverage before making a transfer and determine whether a new policy or applicable endorsement may be needed.

⚠️ A small ownership change on paper can make a big difference when it comes to coverage.

🗺️ : “Proposed” doesn’t always mean dedicated.

A recent Georgia appellate decision is a good reminder that when a subdivision plat labels an area as a “proposed road,” the title review shouldn’t stop with the original plat.

In Cobb County v. Sotis, the court looked at decades of later records, including subsequent plats, county disclaimers, easements, and a quitclaim deed. The court ultimately found the disputed area had not been dedicated as a public road.

🔎 The title tip: When plat language is qualified or unclear, dig deeper into the full title history. Later recorded documents and the government’s own actions can be key to determining whether a dedication actually occurred.
