⚖️📑 Specific beats general and courts will enforce it 🏛️

In 1723 S. Michigan (Chicago) Landco LLC v. Chicago Title Ins. Co., a federal court held a Schedule B specific exception stayed in place even after a General Exceptions Endorsement removed broad non record exclusions 📄

The insured argued the endorsement eliminated all non record risk. The court disagreed, holding the specific City and public alley rights exception for an 8 foot strip was still fully enforceable and did not conflict with the endorsement 🚫📏

💡 Takeaway for title agencies and underwriters: General Exceptions Endorsements expand coverage but do not erase clear, specific Schedule B carve outs. If it is clearly written, it stands 📌

Before heading off to James Madison University this fall, Carter is spending the summer helping the Title Write team with file prep, opening files, binder organization, and supporting our team wherever needed.

Between tutoring math students for the past two years and captaining a nationally ranked Ultimate Frisbee team, Carter already brings leadership, organization, and great energy to the office and we’re excited to have him on board this summer! ☀️
