Many people are not aware that a new federal rule from the U.S. Treasury’s Financial Crimes Enforcement Network (FinCEN) is starting to affect certain real estate transactions across the country, including here in New Jersey.

The goal is to increase transparency and help prevent money laundering in real estate. Certain all-cash purchases involving entities like LLCs or trusts will now require extensive additional reporting so the true beneficial owners of the property are identified.

For most everyday buyers and sellers, the process will still feel very similar. However, if you’re purchasing through an business/entity and planning a cash transaction, there will be a few extra steps or disclosures involved during closing.

Real estate rules are evolving quickly, and it’s important to understand how they could affect your purchase, sale, or investment strategy.

We just had an office meeting on this: DID YOU KNOW —
• You may NOT deny any service animal in housing covered by the Fair Housing Act (FHA) or NJ Law Against Discrimination — even with a no-pets policy.
• There is NO government registry for service animals.
• Tenants are NOT required to provide certification, ID cards, vests, or paperwork.
• Online “registries” and ID cards are not official and not required by law.
• No pet fees, pet rent, or pet deposits may be charged for service animals.
âś” If the disability or need is not obvious, landlords may ask ONLY TWO QUESTIONS:
1. Is the animal required because of a disability?
2. What work or task has the animal been trained to perform?
EMOTIONAL SUPPORT ANIMALS (ESAs)
• ESAs are NOT service animals under the ADA.
• HOWEVER — in New Jersey, ESAs ARE protected in long-term housing under:
â–Ş Federal Fair Housing Act (FHA)
â–Ş NJ Law Against Discrimination (LAD)
• For long-term rentals, landlords must make reasonable accommodations when the tenant provides reliable documentation from a licensed healthcare provider confirming the disability-related need.
• ESAs do NOT have the same protections in short-term rentals or hotels (unless a local ordinance says otherwise).
WHAT TENANTS ARE STILL RESPONSIBLE FOR
âś” Any damage caused by the animal
âś” Keeping the animal under control
âś” Following reasonable health, safety, and noise rules
Landlords may deny or remove an animal if it is aggressive, out of control, or poses a direct threat.
IMPORTANT NJ NOTE
New Jersey enforces one of the strongest anti-discrimination housing laws in the country. Improperly denying a service animal or ESA can expose landlords to significant legal penalties.
