UPDATE: the vote has been postponed and the bills will not be going to the floor tomorrow. Looks like it will be next week. Welcome to the crazy world of Session!!!! Please continue to call and email your representatives and let them know nicely that their constituents want a YES vote.
ACTION NEEDED!!!!! CALL OR EMAIL your Representative in the Oklahoma House of Representatives and URGE THEM TO VOTE: YES!!!! and YES!!!! TO HB2022 and HB2023 TOMORROW. Tag people in the comments. Get the word out. This sets the tone for medical ma*****na legislation in 2021, and we need it to pass, BIG!!!!
They will be heard on the Floor of the House of Representatives at 9:30 AM, and when the Floor Agenda is published, you will note that THEY ARE THE ONLY TWO BILLS TOMORROW. As I’ve said, we are working like hell to push through the much needed fixes to the medical program. These are two critical first steps that lay the foundation for things to come because if we struggle here, it’s going to be a long session.
I posted this the other day, but below is a summary and links to each of the bills.
HB 2022 (Fetgatter)- Opens access to the Oklahoma Medical Ma*****na Program to CITIZENS OF ALL 50 STATES!!! That’s right, no matter where someone calls home, they can now come to Oklahoma and get a patient license to use medical ma*****na to treat their medical condition. Someone can correct me if I’m wrong, but this would make Oklahoma the first state to do that in the country. Some states, like Oklahoma’s 6 month temp license previously, allow some form of reciprocity, but THIS IS MUCH BIGGER!! This would mean it doesn’t matter if the person comes from a state with an existing medical program (hello Texas and Kansas Residents!! Missouri and Arkansas, have a overly restrictive program with expensive medicine because you have 20 grows, well come on to Oklahoma and pay us a visit or 500). This bill not only helps all of those patients that don’t have access or affordable meds in their home state, but it also, EXPANDS THE MARKET FOR EVERY OKLAHOMA MEDICAL MA*****NA BUSINESS. SB 1033 (Leewright)- grandfathers in every Dispensary already licensed from being shut down if they are within 1,000 feet of a school or preschool. When the measuring point was changed in 2019, the existing businesses were not grandfathered in and the measuring points changed. Lots of dispensaries faced closure due to the change in measuring points and the addition of preschool to the list. Still others faced closure because OMMA made mistakes and missed schools and preschools when they issued businesses a license through no fault of the owners. This ENSURES THAT ALL DISPENSARIES GET TO STAY OPEN!! (Remember when that attorney filed that lawsuit against OMMA last year and got an injunction to protect all of these businesses last year when Gov. Stitt vetoed HB 3228 which fixed this issue? Hmmmm, wonder what lawyer that was that did that? Sorry, had to say it because I’m sick of being accused of being a big business sell out when this protected mom and pop shops across Oklahoma, and I did it for absolutely no fee like every lawsuit I’ve filed). HB 2023 (Fetgatter)- Eliminates the prohibition against license transfers that was in 788 for reasons I still don’t understand. In other words, this allows Oklahoma Medical Ma*****na Businesses to sell their business and transfer their license. THIS IS A MAJOR, MAJOR, MAJOR STEP IN THE RIGHT DIRECTION. Remember when I said we have to start doing something to make having a license have value, this does that!!!
