FORBEARANCE:
The Known and Unknown
With approximately 3.8 million homeowners in a forbearance plan (According to the Mortgage Bankers Association as of April 26, 2020)

What We Know

The CARES Act provided borrowers the right to request forbearance for up to 12 months. Initial forbearance requests are granted for up to 180 days and may be extended another 180 days.

CARES Act forbearance provisions only apply to loans backed by Fannie Mae, Freddie Mac, FHA, VA, or USDA. The missed payments are not forgiven and must be made up at some point. Borrowers who are unable to bring their loan current at the end of the forbearance period must apply for additional relief with their servicer.

Early in the forbearance story, many servicers were telling borrowers they must bring the loan current at the end of the forbearance period. Fannie Mae and Freddie Mac have both made it clear that borrowers will not be required to bring the loan current at the end of the forbearance period. Borrowers who are unable to make up the missed payments will be given options to catch up gradually or modify their mortgage.

What We Don’t Know

While Fannie Mae and Freddie Mac have clearly stated that borrowers in forbearance will not be required to make up all missed payments at once, how servicers will handle the requests for continued relief is unknown. Borrowers must apply for additional relief at the end of the forbearance. Therefore, borrowers enter forbearance periods without knowing their options at the end of the forbearance period.

Forbearance will certainly affect a borrower’s ability to refinance their mortgage or obtain a new mortgage. Borrowers are not reported as delinquent during a forbearance, but the fact that the loan is in forbearance is often reported. Lenders are waiting for direction from Fannie Mae, Freddie Mac, and the government agencies on how to handle future loan requests from borrowers who entered into forbearance agreements.
Borrowers who truly need forbearance should not be discouraged from seeking much needed financial relief. However, they should fully understand all the potential implications of entering into any type of forbearance agreement.
