Joint Tenancy May Affect Your Estate Plan

Joint Tenancy with Rights of Survivorship can allow the property to pass to the other person on title when you pass away. But in Florida, it’s important to consider how the deed fits into your overall estate plan.

Florida law provides certain protections for spouses and minor children. So, if you purchase a property with a friend or sibling and pass away, the property may not ultimately go to them as you intended.

Do You Need New or Updated Title Insurance for a Revocable Trust?

When creating a revocable trust, the answer is generally no. You’re the settlor, trustee, and beneficiary, so you remain the owner of the property. Even though the title to the property is changing into the name of the revocable trust, because of the revocable nature of the trust, you typically do not need to obtain updated title insurance.

However, you may need updated title insurance if you transfer the property into a land trust or an irrevocable trust.

Lady Bird Deeds: What You Need to Know

Lady Bird Deeds allow you to assign remainders to the title of the property, so if something happens to you, the property automatically goes to the remainder. However, if your remaindermen are minors, they may not be able to legally receive the property, which could defeat the purpose of creating the Lady Bird Deed in the first place.

It’s important to meet with an estate planning attorney to determine whether a Lady Bird Deed will work for you, or whether it should be part of your overall estate plan. This way, your attorney can help guide you toward the best path to meet your specific needs and goals.
