Florida has some new laws effective July 1, 2023. As I understand it, the following is now law:
Alimony: permanent, periodic alimony no longer exists. There will only be three types of alimony: Bridge the gap, maximum of two years. Durational alimony, and rehabilitative alimony. Rehabilitative has a maximum of five years. Durational alimony is only for marriages of three years or more, no alimony under three years.
A-short term marriage will be from 3 years to 10 years. Alimony cannot be paid for longer than 1/2 the term of the marriage
A moderate term marriage will be from 10 years to 20 years. Alimony can be paid for up to 60% of the length of the marriage.
A long-term marriage will be for 20 years or greater. Alimony can be paid for up to 75% of the duration of the marriage.
This is not what I believe most attorneys wanted, but this is what we got.
Also, child custody will now be 50% for each parent, 50-50. To get anything else you will have to show a substantial reason for it. No more arguing over where little Johnny sleeps on Tuesday night. Most cases will end up being week on, week off.
