Please take time to read this information from KDWP. All too often agents tout that a property qualifies for a landowner tag without knowing the laws. And they fail to ensure their clients take title properly opening them up to fines and criminal penalties. Please consult an experienced land specialist prior to blindly buying land to obtain a tag.
Fraudulent landowner and tenant deer permits/tags continue to be a major issue that Kansas Game Warden's deal with every deer season.
Remember:
• Must own at least 80 acres in simple ownership with their name on the deed to qualify as a landowner.
• An individual cannot qualify as a landowner when land is deeded to an LLC or other legal entity.
• One cannot be a landowner and tenant of the same property.
• A qualifying tenant is any resident or nonresident who is actively engaged in the agricultural operation of 80 acres or more of Kansas farm or ranch land for the purpose of producing agricultural commodities or livestock and (A) has a substantial financial investment in the production of agricultural commodities or livestock on such farm or ranch land and the potential to realize substantial financial benefit from such production or, (B) is a bona fide manager having an overall responsibility to direct, supervise and conduct such agricultural operation and have the potential to realize substantial benefit from such production in the form of salary, shares of such production or some other economic incentive based upon such production.
• Special Hunt Own Land: This permit may be issued to individuals who qualify as lineal ascendants or descendants, their spouses, or their siblings of resident landowners, resident or nonresident tenants. Qualifying individuals do not need to be a Kansas resident. Nonresident landowner ascendants or descendants, their spouses, or their siblings do not qualify for this permit.
