In California, the law governing the display of political signs within Homeowners Associations (HOAs) is primarily addressed by California Civil Code Section 4710. This law provides residents with certain rights to display political signs, but it also allows HOAs to impose reasonable restrictions.

Key Points of California Civil Code Section 4710:

Right to Display: Homeowners have the right to display political signs on their own property, including within the window or on the door of their unit.

Reasonable Restrictions: HOAs can impose reasonable restrictions regarding the time, place, and manner of displaying political signs. However, these restrictions cannot effectively prevent residents from exercising their right to display political signs.

Duration: HOAs can limit the time frame during which political signs can be displayed. Typically, signs can be displayed up to 90 days before an election and must be removed within 15 days after the election.

Size and Quantity: HOAs may set restrictions on the size and number of signs, but the restrictions must be reasonable. The law does not specify exact dimensions, so what is considered "reasonable" might vary from one HOA to another.

Common Areas: The law allows HOAs to prohibit political signs in common areas, meaning areas that are jointly owned or accessible by all members of the HOA, such as lobbies, hallways, and shared lawns.

Enforcement

If an HOA enforces restrictions that are too restrictive or violate California Civil Code Section 4710, homeowners may have legal grounds to challenge the HOA’s rules. In some cases, disputes can be resolved through internal HOA procedures, mediation, or through legal action if necessary.

It's important for residents to review their HOA’s governing documents (CC&Rs) to understand any specific rules or restrictions that may apply to their community, as long as these rules are in compliance with state law.

Albert Management was recently recognized with a CACM Vision Award for Company Culture. A number of employees attended the recent CACM Law Seminar in Anaheim, CA where we were honored above all other CACM management company members in Southern California.

The CACM Company Culture Award recognizes management companies who work hard to create a culture and identity that’s unique. One that helps retain staff, positively impacts the actions and attitudes of their team and fuels growth. Nominees in this category also are involved in community service and social responsibility, as both form part of the overall cultural fabric of the business. This award recognizes all factors that influence company culture. Our alternative work week was a significant factor for the judges.
