The Department of Homeland Security has proposed a new rule that would create a new $103,265 fee on every cap-subject H-1B petition. While the proposed fee is likely to face legal challenges, it is another reminder of the volatility of the H-1B program and why many H-1B visa holders are taking a close look at EB-5.

While the Department of Homeland Security took a little longer than usual to release the September 2026 Visa Bulletin, there was no impact for EB-5 investors. All three set-aside categories remain current for all countries and there was no change for China or India in the unreserved category.

With a little more than a month remaining before the September 30th grandfathering date, concurrent filing remains a possibility for investors that are already in the U.S. on a valid visa. Stay tuned for future updates.

The Department of Homeland Security recently announced a proposed rule that would eliminate the 60-day grace period afforded to noncitizen workers who have their employment sponsorship terminated. The current grace period given to workers, often on an H-1B or L-1 visa, provides time to find a new sponsor as well as an adequate period to prepare to leave the U.S.

The announcement from DHS highlights the benefits of the EB-5 program, which has no employer sponsorship requirements. For many noncitizen workers, EB-5 may provide a better path forward.

Wednesday marked the one-year anniversary of the soft opening of the Seahaus Hotel, part of the Tribute by Marriott Collection. This EB-5 hospitality project is the first full-service nongaming casino on the famed Atlantic City Boardwalk.
