I've received a lot of calls and texts regarding the recent headlines in the media surrounding Real Estate commissions and the NAR lawsuit settlement. I don't typically like to get too caught up in things but feel like I should give my 2 cents.

1. A lot of the headlines you've seen have been extremely misleading. Headlines like NAR slashes the industry standard 6% commissions.

This is a False statement. Commissions have always been "Negotiation-able" and they aren't going away. There has never been a set mandatory commission. Sellers could choose to not offer anything to a buyers agent but it is in their best interest to incentive the agent to bring their buyer.

2. This will reduce the prices of homes.

This is also false. Reducing commissions or changing how they are paid has nothing to do with the price of the home. Homes will not all of a sudden begin listing and selling 3% less.

3. Buyers and Sellers can each pay their own agent.

There has been discussions that sellers should pay their agent and buyers pay theirs. In theory it makes sense but it adds another bill on top of an already expensive purchase for the buyer.

It really hurts buyers who can not afford representation because they will chose to go directly to the listing agent. Listing agents aren't just going to work for the buyer for free and their fiduciary duty is to represent the seller. This will bring about a significant number of cases regarding conflict of interest and buyers being taken advantage of.

Lastly all of this is hypothetical at the moment. Although the NAR settled it does not mean the courts have accepted their settlement. We still have a long way to go and we'll see the way things play out. For now it's business as usual.

I feel it's even more important now than ever to build relationships and have an agent you know you can 100% trust!
