IMPORTANT: The new Massachusetts law, effective October 15, 2025, protects a buyer's right to a home inspection, making it illegal for sellers to condition an offer on a buyer waiving their right to inspect, or to accept an offer from a buyer who states they will waive the inspection. The law aims to increase transparency and protect buyers, especially first-time buyers, from the pressure to skip inspections in competitive markets. However, the law does not require buyers to get an inspection, and exceptions exist for sales between close Family Sales, (child, spouse, parent), Auctions/Forclosures, Commercial Sales and New Construction.
The law was put into place to protect consumers from financial harm due to undisclosed issues in a home; especially with a competitive market where waiving home inspections have been the norm/ common to gain acceptance.

I'll break it down:

*Buyers can't place no inspection or waiving inspection on an offer

*Buyers agents can't divulge/ hint/ converse to the listing agent of the buyers intent on waiving an inspection to be more competitive.

*the listing agent can not know ahead or discuss a waiver of inspection with the sellers

* there's new forms between the sellers, buyers and agents, as well as language on the purchase and sales agreements.

*Sellers are prohibited from accepting and offer with an inspection waiver

*Sellers can not demand or negotiate a waiver of inspection

*Sellers have to provide a home inspection disclosure before an offer is accepted/signed

The buyer can, after offer is accepted, waive their right to a home inspection, but again, can't divulge beforehand of their intent. This law protects the right to have an inspection, but it's not mandatory.
