A local ordinance in Berkley Township restricted home ownership in 55+ communities by age.

But New Jersey Realtors, trade association group, argued it violated the federal Fair Housing Act and the New Jersey Law Against Discrimination. A state appeals court ruled that it was, in fact, unlawful in a first-of-its-kind decision.
