You may or may not have heard about the recent lawsuit against NAR (National Association of Realtors). If you plan on selling or buying a new home in the future, this info could be valuable to you. (Scroll to the bottom of this post for TL/DR version).

The main reason for the lawsuit was the allegations that the National Association of Realtors and several large brokerages conspired to inflate real estate agent commissions, leading to anti-competitive practice, or price fixing. The lawsuit claimed these practices were unfair to home sellers and forced them to pay inflated commissions to buyer agents, reducing transparency and competition (RealEstateNews.com). The goal of the lawsuit is to address and reform commission structures to ensure fairer practices and greater transparency in real estate transactions.

I've been a licensed agent for a little over 5 years and every transaction I've done has been negotiable, and my clients were made aware of it. I'd argue that the majority of real estate agents let their clients know the commission is negotiable. Of course, there are some bad apples out there who do not let homeowners know that commission is negotiable.

One of the changes that will take place if/when the lawsuit is finalized is that a buyer's agent commission will not and is not allowed to be advertised on an MLS listing. This change leads home sellers to think they should not offer a buyer's agent commission placing an additional burden on the buyer.

In many real estate transactions, buyers are financed on slim margins meaning they don't have many or any excess funds to pay their buyer's agent's commission. This will likely turn buyers away from home sellers unwilling to pay a buyer's agent commission. Less buyers means less competition, and less competition means a lower sale price.

I can speak on this from a recent personal experience. I listed and sold a home offering 0% commission to a buyer's agent. The home was in a HIGHLY sought after area. I hosted 2 open houses that generated a LOT of traffic. What I did NOT receive a lot of were offers. There were a total of 3 which isn't bad, but more were expected based on the open house turnout and feedback.

During the 2 open houses, 3 local real estate agents walked through and SPECIFICALLY said their client will not be submitting an offer because there was 0% commission being offered. I received phone calls from 2 other real estate agents who said their clients will not be submitting an offer. That is a total of 5 additional offers that would've created leverage for the seller to receive a higher offer.

While my clients were happy with the sale price, they knew they could've received more had they agreed to offering a buyers agent commission.

(TL/DR)
As a home owner, you have the right to negotiate how much you will pay in commission for the sale of your home. Different real estate agents provide different levels of value. Some agents earn higher commissions because they provide a higher level of value than other agents.

To some up the novel I just wrote, you should absolutely offer a buyers agent commission when you list your home for sale. That will help you net the highest amount once it is sold.
