The foreclosure moratorium is over. Where are all the foreclosures?

I recently attended a webinar featuring Amy Neumann, First VP, Director of Late Stage Delinquency for Flagstar Bank and John Dunnery, VP, Government Loan Servicing for Community Loan Servicing (formerly Bayview) in regards to upcoming foreclosure volume. Neither one of these executives expect a surge in foreclosures this year.

They explained that many people who may have gone into forbearance at the beginning of the pandemic are working again and are able to pay their mortgage. For those who are struggling, there are many more workout programs available than there ever were before. The Consumer Financial Protection Bureau (CFPB) requires lenders to make multiple contacts with borrowers via phone and letters to relay their options before they can foreclose, and in many cases, the lenders have been able to offer a suitable workout solution to the borrower. In addition, Ms. Neumann stated that they are seeing many of the past due loans being paid off, which means the mortgagor most likely sold the home because they had equity.

Q1 2022 has primarily been spent making sure all options with delinquent homeowners have been exhausted. Mr. Dunnery said that you will see a spike in foreclosure activity in Q2 & Q3 this year and then it should level off again.

I was at an REO conference in Dallas this week. Big question is always - when are the foreclosures going to hit? The federal foreclosure moratorium has ended, however, the servicers are required to try to work with homeowners to find options before foreclosing, so we really won't see much change until 2022 although they have started to foreclose on some vacant properties. Here is the surprising news - even these top executives at the banks and servicers really don't know how this will all play out and how many foreclosures there will be! We know it won't be like 2008-2012. Many people in forbearance did it as a precautionary measure and not out of necessity, so they may be fine. Many homeowners have equity because of the large appreciation in values across the country, so they may sell before being foreclosed on. I was so surprised that these executives don't really now the answer as to what the volume is. One thing they seem to agree on is it will start as a trickle and increase over an 18-24 month period.
