She lived in that house for twenty-two years. She’d cooked in that kitchen, raised her stepchildren in those rooms, built her entire life inside those walls.
She assumed the house was hers when her husband passed.
It wasn’t. Not entirely.
Because he died without a will. And in Texas, when there’s no will, the law applies a set of rules that don’t account for relationships, history, or what anyone wanted. They just apply.
In this case, those rules gave his children from a prior marriage a legal ownership interest in the home — even though she was still living there.
She had the right to stay. But not to sell, refinance, or make major decisions without their agreement.
This situation is more common than most people realize.
