Every week I see investors online asking questions that could save — or cost — them hundreds of thousands of dollars. Here are 5 real scenarios and my answers:

Scenario 1: “Can I use a 1031 to exchange into a property in a different state?”
YES. Like-kind exchange rules have nothing to do with geography. You can sell in California and buy in Florida — totally valid.

Scenario 2: “What if I can’t find a replacement property in 45 days?”
The 45-day identification deadline is non-negotiable. However, you can identify up to 3 properties (or more under specific IRS rules). Start your property search before your relinquished property even closes.

Scenario 3: “My partner wants to cash out but I want to 1031. What do we do?” This is solvable. Tenancy-in-common structures and partnership drop-and-swap strategies can allow different outcomes for different investors. Call us before signing anything.

Scenario 4: “Can I exchange into a foreign country?”
NO. Section 1031 applies only to property within the United States. International real estate does not qualify.

Scenario 5: “I’m selling an Airbnb. Does it qualify?”
Depends on usage. If you’ve rented it at fair market value for 14+ days/year and kept personal use under 14 days or 10%, it may qualify.
