The NAR Settlement, Two Years Later: What Marin Buyers & Sellers Should Know
The NAR commission settlement has been in effect since August 2024, and the dust has settled. Here’s the reality check:
🏡 What changed: Sellers no longer have to offer buyer-agent compensation via the MLS. Buyers now sign a written agreement with their agent upfront, spelling out how that agent gets paid. Commission terms are more explicitly disclosed and negotiable — always were, but it’s now in writing.
💰 Who pays the buyer’s agent? Seller, buyer, or a split — it’s negotiable case by case.
📊 What hasn’t changed: Nationally and in Marin, commissions have remained stable. Discount brokerages haven’t gained real market share. And home prices in Marin remain driven by the same old forces: tight inventory and strong demand, not commission structure.
🔑 Bottom line: More paperwork, more disclosure — but the value a skilled buyer’s agent brings to a complex, high-stakes Marin transaction hasn’t gone anywhere.
