Italian Notary vs. U.S. Notary: They Are Not the Same Thing​

One of the biggest surprises for Americans buying property in Italy has nothing to do with prices, taxes, or bureaucracy.​ It’s the notary.

In the U.S., a notary public is someone who checks IDs and witnesses signatures.​ In Italy, the notaio is something completely different. In fact, assuming they are the same is one of the fastest ways to misunderstand how an Italian real estate transaction actually works.

In Italy, the notaio is a public official appointed by the state, with a law degree and years of specialized training behind them. Becoming a notaio is one of the most selective professional paths in the country. Many lawyers try. Very few succeed. Their role goes far beyond paperwork.​

The notaio:
​- verifies ownership and title history​;
​- checks for liens, debts, and legal issues​;
​- drafts and authenticates the deed​;
​- collects and pays taxes​;
​- records the transaction with the land registry​;
​- and ultimately guarantees the legal validity of the sale.

Without a notaio, a property purchase in Italy simply cannot close.

In the U.S., these responsibilities are split among multiple professionals: title companies, escrow officers, and, in some cases, attorneys.
In Italy, they are centralized under a single highly accountable figure.
This difference is critical for foreign buyers.

Many Americans hear the word “notary” and assume a minor administrative role. In reality, the Italian notaio functions much more like a title company and escrow officer combined, with personal liability if something goes wrong.

Italian Citizenship by Ancestry: A Reality Check (2025)

Over the past few months, I’ve been receiving an increasing number of inquiries from Americans who are convinced that having an Italian grandparent, great-grandparent, or even a sibling with Italian citizenship automatically allows them to move to Italy.

Until recently, this belief was widespread.​ As of March 28, 2025, it is no longer accurate.

Italian citizenship by descent (iure sanguinis) has undergone a significant legal change. The rules are now stricter, clearer, and far less flexible than what many blogs, forums, and social media posts still suggest.

A few points that are worth clarifying:

• Having Italian ancestry does not automatically grant citizenship.

• Having a sibling with Italian citizenship does not give you a shortcut.

• Owning property in Italy does not grant residency.

• Starting a citizenship process does not allow you to live in Italy while waiting.

These misconceptions create frustration, wasted time, and unrealistic expectations, especially for people who are also considering buying property or “relocating” to Italy.
