What Trustees Need to Know About Real Estate Disclosures

Selling a home in a trust comes with unique responsibilities—especially when it comes to disclosures. While trustees are exempt from the full Seller’s Transfer Disclosure Statement (TDS), you are not exempt from disclosing what you personally know about the property.

Here are the key disclosure items trustees should be aware of:

1. Exempt From TDS, Not From Transparency
While the California Civil Code allows trustees to skip the TDS, you must still complete the Exempt Seller Disclosure (ESD). This form covers any material facts you’re aware of that could impact value or desirability.

2. Deaths on the Property
California law requires disclosure of any death on the property within the past 3 years—regardless of cause. Even as a trustee, this still applies. If the death was more than 3 years ago, it only needs to be disclosed if you believe it materially affects value.

3. Repairs, Defects & Known Issues
If you’re aware of roof leaks, water intrusion, pest issues, structural problems, or needed repairs, they must be disclosed. Even if you never lived there, anything you discovered during your oversight of the trust counts.

4. Neighbor or Boundary Disputes
If you know about shared well agreements, boundary disagreements, easements, or neighbor conflicts, these are material and must be noted.

5. Environmental or Safety Concerns
Mold, asbestos, septic issues, well problems, or known code violations should all be disclosed. You don’t need to investigate—only to share what you know.

6. “As Is” Still Requires Disclosure
Even if the home is being sold in its current condition, disclosures are still required. An “as-is” sale does not remove the obligation to be transparent under California law.

The bottom line:
Trustees aren’t expected to know everything—but you are expected to disclose what you actually know. Clear, accurate disclosures protect you legally and help create a smoother, more successful sale.

Before Selling a Home in a Trust — What You’ll Need to Get in Order

If you’re the trustee and preparing to sell a property, there are a few key documents and steps to have ready before we can move forward smoothly:

✅ Trust Documents — We’ll need a full copy of the trust (or at least the certification of trust) to confirm who has authority to act.

✅ Death Certificates — If any of the original trustees or trustors have passed, certified copies are required for title and escrow.

✅ Doctor’s Notes (if applicable) — If a trustee or trustor is incapacitated, documentation from a physician verifying incapacity may be needed to activate a successor trustee’s authority.

✅ Valid Identification — Every acting trustee will need a current photo ID for notary and title purposes.

✅ Communication with Beneficiaries — Make sure all beneficiaries are informed about the plan to sell to help avoid delays or disputes later.

✅ Real Estate Market Plan — Once the legal side is squared away, we step in to manage the rest — preparing the home, coordinating repairs, and guiding you through every detail of the sale.
