Everyone's heard a lot about the "booming real estate market" in the past year or two and it's the type of thing that grows and takes on a life of it's own with all the "hype". But sometimes the "grapevine" can be a little deceiving. Indubitably, it's been a seller's market...and a great one at that! But the 2019 year to date numbers are out from the Wisconsin Realtor's Association and to put things into perspective, in Marathon County Wisconsin (where I live) the median sales price went up from $155K in 2018 to only $166K in 2019. This represents a 7.1% increase. In other words, a home worth $100,000 in 2018 might have been worth $107,000 in 2019. Meanwhile, YTD sales went down from 1,866 in 2018 to 1,795 in 2019, which represents a 3.8% decrease.

Did you know that in the State of Wisconsin, as a Buyer, your real estate agent “could” actually be working for the better interests of the seller, rather than for “YOUR” best interests? Hard to believe, right? After all, you’ve looked at 15 or 20 properties with this agent and you FEEL as though you’ve established a reasonably cordial and trusting relationship with them. Do you remember them talking to you about representation or Buyer Agency? On the current 9 page WB-11 Wisconsin Offer to Purchase, the VERY FIRST LINES, lines 1 & 2 (of 462) states: “Licensee drafting this offer on [date] is (AGENT OF BUYER) (AGENT OF SELLER/LISTING BROKER) (AGENT OF BUYER AND SELLER) [STRIKE THOSE NOT APPLICABLE]”. The fact is, when a real estate agent lists a home for sale, there is one legal binding contract in place. This contract is known as the listing contract and it’s signed by the Listing Agent (who by default, represents the seller and the seller’s best interest) and the Seller themselves. When another [co-broke] agent brings a buyer through this property and that buyer indicates to their agent that they really like the property and that they would like to write an offer, needless to say their agent obliges and an offer is subsequently drafted. However, assuming you do not have a Buyer Agency agreement with your agent, there is only ONE legal binding contract in place for that entire transaction and that’s the Listing Contract between the Listing Agent and the Seller.
