Single-Family Home Rental Protections Upheld by Sonoma County Board of Supervisors
Following months of advocacy and engagement, the Board of Supervisors (BOS) voted 3-2 to reject proposals for enhanced rent control, penalties for legal evictions, and a fee-based rental registry for most single-family homes. An ordinance will now be drafted to reflect the agreements below, then return for a final vote.

The California Tenant Protection Act of 2019 (CTPA) created rent control and “just cause” eviction for most multifamily properties. Since its passage, other state laws have added additional limits and requirements. Before the BOS were fifteen options to expand these policies significantly, including relocation payments, legal eviction limits, and expanding to single-family homes.

NorBAR thanks Supervisors Rabbitt and Gore for their close collaboration with the housing community and their judicious opposition to policies that exceed state law – both voted no on the final motion. While we did not support the additional policies in the approved motion, we appreciate that Supervisor Hopkins declined adding CTPA-exempt single-family rentals and a fee-based rental registry to the new provisions. NorBAR aims to serve as a resource and partner for decision-makers on issues affecting our housing economy. We thank our government affairs team, members, industry partners, and the housing providers that wrote in and spoke out at the hearing – your efforts made an essential impact on the County’s grasp of the importance and complexity of the rental housing environment.

STATUS

No changes have been implemented yet - the changes below are a draft/informal summary from the hearing. NorBAR will monitor the ordinance's development and notify members of any concerns.

Removal of exemptions for income-restricted (affordable) housing, certain partially owner-occupied properties, and special purpose housing like nursing and dormitory facilities, making these subject to CTPA mandates

Eviction protections for properties under the CTPA will start on day one of tenancy (rather than after 12 months), with a one-month relocation payment for no-fault evictions; relocation assistance to be calculated at the HUD Fair Market Rent rate or current rent, whichever is higher

For properties under the CTPA, for-cause eviction for non-payment of rent limited until rent is one month late

A rental registry was not approved; 3 Supervisors supported mandating a standardized County notification form (no fees, registration, or monitoring).

A COVID-era-type eviction ordinance to take effect during disasters/emergencies, with specific criteria to determine eligibility (e.g., loss of units, pandemics).
We face a housing affordability crisis that has developed over multiple decades. Chronic under-development, economic insecurity, and a weak safety net have led to proposals that merely impose payments and penalties on housing providers as a solution. These measures are counterproductive, and can undermine affordability, compromise property rights, and cause financial hardships for both tenants and housing providers.

RESOURCES

California Tenant Protection Act (CTPA): Generally, state law is in effect through January 2030, and created rent control and “just cause” eviction for most multifamily properties. Since its passage, other statewide laws have augmented the Act.

ALERT::!!!
Sonoma County: Do You Buy, Sell, Own, or Manage Rental Property?

We are again at a pivotal moment in addressing the housing affordability crisis. On May 21, the Sonoma County Board of Supervisors (BOS) will consider new rental housing policies. In December, the BOS, staff, and advocates highlighted the options below:

Expanding all state mandates to single-family homes; eviction and rent restrictions
Expanding landlord-paid relocation payments to tenants for legal evictions (up to 3 months rent)
Restricting owner’s ability to remove the property from the market; rent control as a supplement
Limiting legal evictions for substantial remodels; creating tenant re-occupation rights
Creating a new rental registry, fees, monitoring, and programs
Creating landlord-paid legal representation for tenants only
Creating an ordinance to automatically apply during emergencies, including a near-blanket prohibition on evictions (4 current declarations)

As members of this community, we understand the challenges faced by renters and rental housing providers alike. We couldn’t agree more – we have a severe housing affordability crisis – and everyone deserves a safe, secure, affordable place to live. The NorBAR government affairs team has been working hard to communicate with Supervisors and staff, and have submitted a range of data and formal input.

HAPPENING NOW!! GET ON THE ZOOM NOW: Register and show up...Plenty of speakers to go. This is the public and company comment time.

YOU REALLY SHOULD BE ON THIS PANEL LISTENING TO THESE POOOOOOR INSURANCE COMPANIES... asking for catastrophe models to return to CA insurance market. OH MY GOSH...don't let it happen, they are RICHER than you can imagine and them leaving has opened up for so many more companies to start up and become companies here in CA.

Department of Insurance to hold public meeting on catastrophe modeling regulation – staying on track for state’s largest insurance reform in 30 years

The Department of Insurance will hold a public workshop on April 23 about a proposed catastrophe modeling regulation that will help restore options for all Californians, the latest phase of Insurance Commissioner Ricardo Lara’s Sustainable Insurance Strategy to safeguard the integrity of the state’s insurance market. The Department is working urgently to implement the state’s largest insurance reform in 30 years, while prioritizing public input and transparency.

Tomorrow’s workshop keeps California on track for a December 2024 goal of implementing new regulations that address the state’s ongoing insurance crisis of limited availability for many Californians. The intent of the workshop is to take input before starting the process of submitting the regulation for approval by the Office of Administrative Law.

Insurance Commissioner Ricardo Lara continues progress toward vital regulatory and administrative reforms under his California Sustainable Insurance Strategy. Changes to outdated regulations are necessary to improve choices for all Californians. The strategy focuses on making insurance available and affordable, especially in high-risk areas.

The regulation will allow the use of forward-looking catastrophe modeling to help support wildfire safety and mitigation efforts, using the latest technology to better predict climate catastrophes. California is today the only state that requires the use of historical data for setting future insurance rates, which is contributing to price increases and limited availability of insurance, particularly in areas with wildfire risk.

WHAT: Virtual public workshop on next phase of Sustainable Insurance Strategy

WHEN: Tuesday, April 23, 2024 at 2PM-5PM/PT
