Five years sounds like plenty of time until your parents are 78 and somebody suddenly needs long-term care.

Medicaid pays a HUGE share of nursing-home care in this country, and one thing a lot of families don’t realize is that Medicaid estate recovery is real.

After someone dies, the state can seek repayment from the estate for certain long-term-care benefits Medicaid paid.

A lot of families don’t learn about that until they’re already dealing with the house, the estate, and a letter from the state.

What this attorney is describing is also real.

A properly structured irrevocable trust, set up and funded far enough in advance, can potentially keep a home from being treated as an available Medicaid asset and can also affect whether it’s exposed to estate recovery.

But people tend to skip over one VERY important word:

Irrevocable.

You’re giving up ownership and control.

Depending on how the trust is written, you may still be able to live in the house, but you generally can’t treat it like you still own it outright.

You can’t casually sell it, refinance it, grab the proceeds, or decide three years later that you want everything back because family circumstances changed.

And then there’s the five-year clock.

It doesn’t start when you start thinking about doing this. It starts when the transfer is actually made.

A private nursing-home room now runs a national median of about $355 A DAY, or roughly $130,000 a year.

So if you wait until Mom or Dad needs care next year, you don’t magically get five years of protection retroactively.

I sat across from plenty of families during my planning years who wanted to start doing asset-protection planning AFTER the diagnosis or AFTER the health crisis.

That’s usually when the options get a whole lot worse.

If your parents own a home and they’re in their 60s or 70s, this is absolutely worth discussing with an elder-law attorney while it’s still planning and not panic.
