It’s good to see the judicial system working to protect home owners!! A big plus of having an HOA these days.
A San Diego County judge ruled that state ADU laws do not override HOA rules in condo communities.
In the case, a condo owner argued a 2019 state law allowed him to convert his garage into a rental unit despite HOA restrictions. The HOA countered that their rules prohibit using garages for anything other than parking.
The court sided with the HOA, finding the law does not clearly apply to condos and is intended for single-family zoning.
