What is a Title Company? A Title Company is a company involved in examining and insuring title claims for real estate purposes. The company verifies ownership of real property and determines the valid owner through a thorough examination of property records in a Title Search. The title company usually does a search which determines; the legal owner of the property, reveals any mortgages, liens judgments or unpaid taxes outstanding on the property and details any existing restrictions, easements or leases that affect the property. During the course of the search, the title company is able to determine who is listed on the deed as an owner of the property. An insurance policy is issued after the title company determines that the title is insurable. Even though an extensive search is done, every so often things are overlooked, such as liens or judgments. In the event of an error or problem, the title company will insure the mortgage deed against those types of events. If someone comes forth and claims an ownership interest, the title company will defend the title and if necessary pay any losses incurred as a result. Title insurance helps prevent claims and losses from taking place. Why is Title Insurance Needed? The American Land Title Association reports that 36% of all real estate transactions have a defect in title. Title insurance protects against loss or damage against any future claims people may have against your ownership of the property.
