🏡Closing Insight 💡 Your client does qualify as First Time Home Buyer assuming the parents are only acting as guarantors (co-signing on the loan) and will not occupy the property.

The required affidavit to be executed at the settlement table has a separate section whereby the parents can certify they will not occupy the property and are acting as guarantors on the purchase money mortgage.

🏡Closing Insight 💡 The sooner we know this information the better. For both Buyer and Seller our attorneys can create a specific Power of Attorney (POA) for a minimal cost. However if your client is the buyer and they are obtaining a mortgage, the lender will need to approve the use of a POA prior.

If either party states, they already have a POA we will need to see it to obtain underwriter approval prior to closing day.

Not all POA’s are equal.

If the Trustee cannot act because he/she is incapacitated, the Trust Agreement will provide who the Successor Trustee is and what is needed to prove incapacitation.

🏡Closing Insight 💡 When someone owns a property in MD or DC, and they passed away, the title to their property passes immediately to the legal entity known as “The Estate of” the deceased. The Estate is automatically vested in the title upon the death. The probate courts will appoint a person, known as the Personal Representative, to administer the estate and they are ordinarily empowered to sell or otherwise convey the estate’s property.

VA is different. In VA, when a property owner passes away, the title to their property automatically passes to the persons named in the Last Will and Testament, or if there is no will, to the heirs entitled to the property by law. A court only intervenes in title matters and appoints an Executrix for sale of real estate in unusual circumstances.

🏡Closing Insight 💡If the owner and her husband took title with rights of survivorship, she was vested in title when her husband died you just need a copy of his death certificate. We can secure the last deed of record for you to confirm how they took title.

We occasionally see a married couple that took title as tenants in common. Sometimes this is due to a mistake on the last deed. If they took title as tenants in common, then the deceased husband’s Will would need to be probated or if he died intestate, a real estate affidavit would need to be filed in the City/County where the property is located.

Bonus Tip: Please check the land records to see if the property was in a Trust. You will see “TR” after the names in the land records. If so, a copy of the Trust is needed

Whether you see a security system or not, always ask your Seller if they have a surveillance system. If so, disclose the use of all surveillance devices. Consider posting a sign that states that the property has an audio and/or video surveillance system in use as a risk management practice.

Utilize a written document which requires indemnification for any unlawful surveillance by the Seller. Additionally, include in the MLS comments that a surveillance system is in use. If the Seller does not think it is legally necessary, let them know that complicated laws govern audio and video recordings. Providing this information also protects the safety of the homeowner and their property.
