Think your property address is enough to identify your home? Not quite!

A legal description is the official, legally recognized way to identify a piece of real estate. Unlike a street address, it precisely defines the property's boundaries and location.

A legal description may include:
📏 Lot and block numbers
🗺️ Subdivision names
🌾 Section, Township, and Range
📐 Metes and bounds measurements

So why does it matter?

The legal description is what appears on deeds, mortgages, title insurance policies, and other recorded documents. It ensures everyone is referring to the exact same piece of property, helping prevent costly mistakes or ownership disputes.

🏡 Title Tuesday: What Is a 1031 Exchange? 💰

Did you know you can potentially defer paying capital gains taxes when selling an investment property? That's where a 1031 Exchange comes in!

A 1031 Exchange allows an investor to sell one investment property and reinvest the proceeds into another "like-kind" investment property, all while postponing capital gains taxes.

📌 Here are a few important rules:
✅ The property must be held for investment or business purposes.
✅ You have 45 days to identify your replacement property.
✅ You have 180 days to complete the purchase.
✅ A qualified intermediary must handle the exchange funds. You can't receive the money directly.

⚠️ A 1031 Exchange does not apply to your primary residence. It's designed for investment and business properties.

What is an Easement?

An easement gives someone else the legal right to use a portion of your property for a specific purpose, even though you still own the land.

Common examples include:
🚧 Utility companies accessing power or water lines
🚗 Shared driveways
🚶 Walking paths or access roads

Most easements are completely normal and don't prevent you from enjoying your property. However, it's important to know where they are and what they allow before you buy.

That's one of the many reasons a title search is so valuable, it helps identify recorded easements that may affect the property so there are no surprises after closing.

Thankfully, everyone signed the right paperwork, and we got to celebrate a successful closing! 🎉
