What is "Fiduciary Duty" and what is owed to a client in a Real Estate transaction? Arizona Admin Code AAC R4-28-110 states that a real estate agent owes a fiduciary duty to the client and shall always protect and promote the client's interests, while dealing fairly with all other parties to a transaction. Bottom line - the client's interests come first. This means honesty, acting promptly, being competent, giving appropriate counsel, which can also be recommending the client get counsel on matters such as legal, insurance, tax and accounting.
In the agency I work with, Award Realty, the agent on behalf of the broker always represents the Seller in a Listing Agreement, even if the agent writes up the contract for another party because they are an unrepresented Buyer. If the Listing agent writes the contract for the Buyer, the Buyer becomes a "customer" and is entitled to honesty, fairness, and disclosure of information that materially affects the sale. But they are not entitled to a fiduciary duty in this case.
However, if the agent writes the contract for the Buyer and the Listing is not held by Award, the agent has fiduciary responsibility to the Buyer, who is the client. Buyer/Broker Agreements put this relationship in writing.
It is important that a Seller and Buyer have trust in the real estate agents that are acting on their behalf and know what their relationship is. The relationship should be explained at the outset so that everything is "out on the table" so to speak. Trust is imperative and honesty is required by all parties. The best transactions are where everyone "wins". Carl and I work hard to make this happen. We truly believe in the Golden Rule.

Bit of bragging. I held the first Fair Housing & Appraisal Practice class on April 28th. This 4 Hr CE class was the first of its kind in the nation according to Lisa Desmarias, VP pf Appraisal Issues, of the Appraisal Foundation (the source of appraisal standards for all US appraisers). As the owner of Arizona Appraisal Seminars & Classes, I was thrilled when she called it a "Great Class". This is a tough topic as there are no hard and fast rules as there are for Realtors(R).

Appraisers must produce an unbiased report according to both Federal and State laws and also the Uniform Standards of Professional Appraisal Practice. However, many appraisers may not be aware of implicit bias they may have, or how to write a report that is free from statements or pictures that may not be neutral, or which may illicit a biased decision from a lender.

This class was long on discussion as the purpose was to make appraisers aware of a bias they may not even know they have as well as take measures to make a report as neutral as possible.

This class will be given at least once a month. Anyone who wishes to audit the class may at no charge. Contact me for more details.

MARCH 3 - WORLD WILDLIFE DAY!
Between 200 and 350 million people live within or adjacent to forested areas around the world, relying on the various ecosystem services provided by forest and forest species for their livelihoods and to cover their most basic needs, including food, shelter, energy and medicines.

Indigenous peoples and local communities are at the forefront of the symbiotic relationship between humans and forest, forest-dwelling wildlife species and the ecosystem services the provide. Roughly 28% of the world’s land surface is currently managed by indigenous peoples, including some of the most ecologically intact forests on the planet. These spaces are not only central to their economic and personal well-being, but also to their cultural identities.

Forests, forests species and the livelihoods that depend on them currently find themselves at the crossroads of the multiple planetary crises we currently face, from climate change, to biodiversity loss and the health, social and economic impacts of the COVID-19 pandemic.

On March 3 2021, World Wildlife Day will celebrate forest-based livelihoods and seek to promote forest and forest wildlife management models and practices that accommodate both human well-being and the long-term conservation of forests, forest-dwelling species of wild fauna and flora and the ecosystems they sustain, and promote the value of traditional practices and knowledge that contribute to establishing a more sustainable relationship with these crucial natural systems.

ONEROUS WEEKEND TASK! It's going to be a beautiful weekend here in Arizona with temperatures in the mid 70's. Great to take a walk, sit on the patio, take the dogs to the dog park, go for a bike ride. On my list is also tackle another project, like cleaning out the file cabinets which I have lined up in the garage, sorting through a few boxes of books and taking things to GoodWill or local shelters. I hate weeding out the papers in my file cabinets. As an appraiser we have to keep our files for 5 years, and although I am now "paperless", there are old files I haven't yet tossed. Plus, I have data on markets going back 30 years that I have occassionally use when completing a forensic report. I also have family files that I find emotionally difficult to purge. We also have a lot of items we use for staging vacant homes that I really need to organize better. Beautiful weekend days, perfect temperatures to open the garage doors, put on music or a book to listen to and go at it. I know I will feel better for it, and so will Carl. Wish me luck.
