What's the difference between seller financing and subject-to-transaction?

Seller financing is a real estate agreement that allows the buyer to pay the seller in installments. So, the seller takes on the role of the lender because he owns the property free and clear. The seller and buyer negotiate the purchase price of the home. They negotiate down payment, closing costs, interest rates, and monthly payments. Better known as terms. The terms can be structured in any way that makes sense for both parties. For sellers, financing the mortgage can make it much easier to sell a house. Rather than using a traditional mortgage from a bank, credit union, or other financial institution. And, typically the seller gets the retail value of the home. It's less stressful and a lot more money for the seller.

A Subject-to agreement is when there's a debt in place. So the buyer takes over the existing debt and takes the title of the home, but the debt stays in the owner's name. The buyer pays off the loan. The mortgage and the loan stay in the homeowner’s name. The only thing that gets put into the buyer's name is the deed. The seller and buyer structure an agreement to determine the offer and exit strategy. It's faster than many other solutions, the seller will be relieved of their financial burdens, keep their credit intact, get some money upfront, and keep their property.
