This is why it’s best to double check how you transfer property before doing so to know how it may impact your taxes.

Thinking of transferring your homesteaded property into a LLC? While a LLC may provide some liability protection it won’t protect your property’s assessment cap from resetting to Just/Market Value. Transferring your property to or from an LLC is considered a change of ownership for property tax purposes under state law, causing a removal of any existing assessment cap on the property and a higher property tax bill the following tax year.

If you’ve already done so this year, you can quitclaim the property back before year end to prevent this from happening in the new year. As always, contact our office at (727) 464-3207 with any questions.

Good info from our property appraiser for Hillsborough County residents.

Your home may be similar even identical to your neighbor's. However, the assessed value and taxes can be very different for several reasons. The assessment of homesteaded properties is capped at 3% per year, and non-homestead properties are capped at 10% per year. The cap starts in the year following purchase, so your neighbor may have purchased their home at a different time than you, resulting in a different capped value.

In addition, Florida property owners can "port" their cap savings from one homestead to another, which also impacts assessed value and taxes. Lastly, your neighbor may benefit from certain exemptions that lower taxable value and, ultimately, taxes paid. A better comparison between similar properties is market value, which is not impacted by caps or exemptions.
