📣 Important Update for Real Estate Professionals & Clients — New FinCEN Rule Effective March 1, 2026

Starting March 1, 2026, the Financial Crimes Enforcement Network (FinCEN) will implement a major new reporting requirement impacting residential real estate transactions across the United States. This is not just another technical rule — it’s a fundamental shift in how certain property transfers are reported and handled. 

🔍 What’s Changing?

The FinCEN Residential Real Estate Reporting Rule requires reporting of all-cash (non-financed) residential property transfers when the buyer is an entity or trust, such as:

• LLCs
• Corporations
• Partnerships
• Trusts

This applies to properties designed for occupancy by one to four families, including homes, condos, and vacant land intended for residential construction. 

🗓 Effective Date:
📅 March 1, 2026 — delayed from the original December 2025 start to give industry professionals more time to prepare. 

📌 Who Must File a Report?
The responsibility to file a Real Estate Report with FinCEN generally falls on settlement professionals like:

✔ Title agents
✔ Escrow officers
✔ Closing attorneys
✔ Settlement agents
✔ Others involved in the closing process

This report identifies the property, buyer entity or trust, beneficial owners, and the transfer details. 

⚠️ Why This Matters
This rule is designed to combat money laundering and illicit finance in the real estate market by increasing transparency — especially in all-cash deals that historically have little oversight.

✔ Start reviewing your contracts and workflows
✔ Train your team on which transactions will trigger reporting
✔ Coordinate early with title/escrow to collect required information
✔ Ensure documentation for beneficial owners is accurate and accessible
