What is the NAR settlement?

The National Association of Realtors (NAR) recently settled a class-action lawsuit alleging that its policies led to higher real estate commission rates. The settlement includes several key changes aimed at increasing transparency and potentially reducing costs for consumers.

**For Buyers:**
**Buyer Broker Agreements**: The settlement clarifies that buyers in order to view homes with a realtor must sign a buyer broker agreement. This gives a fiduciary from the buyers realtor to the buyer for true buyer representation. This also may affect commissions paid to a buyer’s agent, it is negotiable. This means buyers can discuss and negotiate the commission rate with their agent. This rate is either paid by the buyer or is negotiated in the purchase of the buyer’s new home with the seller.

**MLS Listing Changes** Listing agents will no longer have to offer a co-brokerage commission to the buyer’s agent.

**For Sellers:**
**Transparent Costs**: Sellers will benefit from clearer definition of commission paid to their seller’s realtor. An explanation of future potential cost of commission paid to the buyer’s realtor in form of concessions or buyer’s prepays and closing cost.
**Potential Cost Savings**: With commissions being negotiable and more transparent, sellers might be able to negotiate lower commission rates, potentially reducing their overall costs.

Overall, the NAR settlement aims to create a more transparent and competitive real estate market, benefiting both buyers and sellers by making commission costs clearer and more flexible.
