Cashier’s check or Wire?
What’s better? What’s required? Why?
- What’s better is going to be different for everyone. We are finding many more borrowers are using online bank accounts, meaning getting a cashiers check can be impossible sometimes or take several days or more to obtain, so those borrowers often are happy to hear they can wire. Others fear wires and prefer a cashiers check. We understand the complexities of each situation, and wires can be scary, but with the proper protocols, verifying verbally, receiving securely, and confirming sender, they are perfectly safe.
- What’s required is a little easier to nail down. We require a wire for any funds being received in excess of $25k. Why do we require that? Cashier’s check do not clear immediately, they can take 5-10 business days to clear, and we are not able to issue proceeds or payoff wires for a transaction until we have cleared funds. The FDIC and Federal Regulations regarding escrow accounts do not legally allow us to disburse without cleared funds. As an escrow agent, we are receiving and disbursing funds for several transactions at any given time, so it is extremely important for us to track those funds, and disbursing a seller wire without cleared funds means we are disbursing funds from another transaction.
- How do we relay this information? When we send scheduling notices to borrowers it will include information about closing including funds to close requirements. This is the initial notification to them with information on what to expect. Once the settlement statement is complete we then send that out with the information about how to provide funds as well. These emails contain a secure link for borrowers to access our wire instructions via ShareFile. We also have the ability to send the instructions via ClosingLock, another secure method requiring multi factor authentication via a text code to the borrower.
Occasionally we can make exceptions to this rule, however how close to the threshold, seller proceeds election, and the issuing banks ability to verify the check all play into this occasional exception.
