Maui's Bill 9 Update:
Maui County has taken the next step in Bill 9’s implementation, advancing new hotel zoning (H-3/H-4) to the Planning Commissions.
This does not rezone any properties yet, but it creates the framework that future decisions will build on. The road ahead is still complex, incremental, and closely tied to planning review, future legislation, and legal outcomes.

A legal challenge has now been filed against Maui County’s Bill 9, just days after the law was signed.
The lawsuit raises constitutional questions around vested property rights and the phase-out of short-term rental use in apartment-zoned properties. While it does not change the law today, it confirms that legal challenges long anticipated during the Bill 9 debate are now underway.

Bill 9 has officially been signed into law.
It’s an important milestone for Maui, but it’s also important to clarify what this law does, and does not, do. Bill 9 does not impact all vacation rentals. It is narrowly focused on certain short-term rentals operating in apartment-zoned districts, often associated with the Minatoya List. Vacation rentals in hotel and resort zoning are not directly affected.
The law establishes a staggered sunset, with enforcement beginning in West Maui in 2029 and all other affected districts in 2031. Implementation will take time, and legal challenges are widely expected.
