As of January 1, 2026, Assembly Bill 723 requires disclosure when listing photos have been digitally altered in ways that materially change the appearance of a property.

So here’s the question…

Is your agent doing this?

If a listing uses virtual staging, sky replacements, enhanced landscaping, altered views, removes permanent features, or adds features that don’t actually exist, those changes must now be disclosed.

The purpose is simple: greater transparency and fewer misleading listing photos.

Not everything requires disclosure. Standard editing like color correction, brightness adjustments, cropping, HDR processing, and removing temporary items such as trash cans or parked vehicles are still permitted.

Whether you’re buying, selling, or marketing a property, it’s important to understand these rules. Failure to comply can result in fines and other penalties.

As AI becomes more common in real estate marketing, working with an agent who stays current on industry changes matters more than ever.
