✨WISDOM WEDNESDAY✨

A legal procedure whereby property used as security for a debt is sold to satisfy the debt in the event of default in payment of the mortgage note or default of other terms in the mortgage document.

There are three general types of foreclosures:

(1) Judicial Foreclosure - This is normally used in states in which no "power of sale" is included in the mortgage document. It provides that upon sufficient public notice the property may be sold by court order. This type is rarely used in North Carolina.

(2) Nonjudicial Foreclosure - This is used in states with a "power of sale" included in the mortgage or trust deed. This gives a lender (or the lender's trustee if a deed of trust is used) the right to sell the mortgaged property upon default without being required to spend the time and money involved in a court foreclosure suit. Almost all North Carolina foreclosures are nonjudicial.

(3) Strict Foreclosure - Some states still allow lenders to acquire the mortgage property. After appropriate notice has been given to the delinquent borrower and the proper papers have been prepared and filed, the court establishes a specific time period during which the balance of the defaulted debt must be paid in full. If full payment is not made, the borrower's equitable and statutory redemption rights are waived, depending on the special circumstances involved in the case, and the court awards full legal title to the lender. No deficiency judgements are allowed in strict foreclosures.

Most states allow a defaulted mortgagor a period of time during which the property may be redeemed after the foreclosure sale. During this statutory redemption period (which may be as long as one year), the court may appoint a receiver to take charge of the property, collect rent or pay operating expenses.

When preparing to purchase a home, the house itself is not the only thing a buyer should consider. Here are a few tips to ensure buyer's remorse won't be something you experience:

(1) Make the location of your home your top priority. Check the amenities in the neighborhood, public transit access, recreation areas and the presence of busy streets.

(2) Consider proximity to work and schools. Check all routes to work and schools by venturing out and personally calculating the commute times.

(3) Consider future developments. Check for potential road expansions and the possibility of more homes being constructed in the neighborhood.

Know what can and cannot work for you and choose your new home wisely.

Fee Simple Absolute refers to an estate in land. It is the highest quality of estate that a person can have in real property. It is of a potentially infinite duration and is transferable, devisable, and inheritable.

It is sometimes referred to as "the fee" or "fee simple" and all other estates (life estates or leaseholds) may be created from it as they are less than fee simple absolute.

Any limitations that exists on the control and use of the land held in fee do not result from the estate's nature itself but the public or private controls governing the land's use (zoning ordinances and building codes or restrictions and conditions).

The fee may also be encumbered, either voluntarily (eg. mortgage) or involuntarily (tax lien). Such encumbrances tend to reduce the value of the fee interest.

If you think that a wild look is still in, think again! A house that looks like a jungle is not appealing to potential buyers. Here are a few tips to help with landscaping:

1. TRIM AWAY SHRUBS AND HEDGES: prune any dead branches and limbs so plants look healthy and fresh

2. REPAIR FENCES AND GATES: remedy any broken pickets, missing latches or holes that may compromise security and privacy

3. ADD ANNUALS: flowers of different colors that bloom in season are a great addition to your yard

4. LOW MAINTENANCE PLANTS: add new varieties of plants that suits your taste and have maintenance requirements that you can keep up with

While each home may require different solutions to landscaping issues, every homeowner should at least attempt to make the property more appealing to potential buyers by enticing them before they enter the front door.

Familial status, as defined in the Fair Housing Act, is a protected class consisting of one or more individuals under age 18 living with a parent or legal guardian or another person given written permission from a parent. Specifically covered are pregnant women, a person in the process of securing legal custody and foster parents.

Under the FHA, familial status discrimination occurs when a landlord, property manager, real estate agent or property owner treats someone differently because they have a family with one or more individuals under 18 years of age.

All families with children are protected against this type of discrimination including single parent households and same s*x couples.
