As we have become a much more litigious society, lawsuits revolving residential real estate transactions has become a hot topic. National association of Realtors has listed the top reasons that make up for the majority of these lawsuits.

1. FAILURE TO DISCLOSE ❌

This revolves around sellers not disclosing to potential buyers material defects of a property. Most Common defects are listed as foundations, roofs, boundary lines, termites and other structural features. Be sure to Utilize the Sellers Disclosure form filled out by the seller (not their agent) to be aware of all possible defects in the property.

2. BREACH OF FIDUCIARY DUTIES ❌

Majority of these cases include claims of undisclosed Dual Agency. NAR’s code of ethics mandates agency disclosure to ensure that consumers are aware if the Realtor they are working with is obligated to work with their clients best interests in mind. The representation agreements Realtors use have paragraphs for dual agency as well as sub-agency. Make sure to ask your Realtor if they are working under either of these scopes. If so, they may not be obligated to advise you thesame way they would be required to if they were hired as YOUR Realtor and yours only. ( In regards to your transaction.)

3. FAIR HOUSING VIOLATIONS ❌

Recent years have seen more fair housing violations brought upon MLS’s with their members using phrases like “ Perfect for empty nesters” or “No children”. I strongly encourage documentation of all services offered/provided to ensure everyone receives equal treatment.

As we head into the busy season, here are 3 pricing strategies for a sellers market!

1. Listing below market value.
This strategy is all about exposure. Listing below market value in a sellers market is a good way to maximize the amount of attention your home gets from buyers, in an attempt to receive multiple offers and create a bidding war. This strategy can also be useful if you have a short timeline and selling the house quickly is a necessity for you.

2. Listing above market value.
No time crunch? You can try to get an awesome offer by listing over the market value! Be careful though. High days on market can be seen as a red flag to buyers, especially when they are seeing other homes fly off of the shelves. When choosing this strategy, talk to your Realtor and put together a game-plan of action if the days on market begins to creep up.

3. Listing at market value.
This strategy is all about data and facts. Have your Realtor go over the comparable sales for your home with you and choose the number that the market shows to support. This strategy can also net you multiple offers in a strong market, and strengthens your position in negotiations. This is a strong strategy when pricing, regardless of the status of the market.
