If you are a foreign property owner considering selling your U.S. real estate, it’s important to understand FIRPTA (Foreign Investment in Real Property Tax Act).

By default, FIRPTA requires that 15% of the gross sales price be withheld by the buyer at closing and sent to the IRS.

However, there is an exception rule:
• If the property is sold for $300,000 or less, and
• The buyer intends to occupy the home as a primary residence for at least 50% of the days it is used during the first two years,

then the withholding requirement does not apply.
