EVICTION: A STEP-BY-STEP GUIDE WHAT TO EXPECT IN EVICTION PROCEEDINGS

Eviction is a legal process through which an owner or person in control of a property may legally require that unlawful occupants vacate a property by way of a court order as any evictions without a court order are therefore unlawful.

We have therefore devised a brief step-by-step guide to explain the important procedural steps required to obtain such an order.

STEPS IN THE EVICTION PROCESS:
1. Has the occupant breached an agreement? If so, a letter of demand will be sent requiring the tenant to remedy the breach.
2. If there is no agreement or the breach has not been remedied, a notice informing the occupants of a date by when they are to vacate the property will have to be sent.
3. Should the occupants refuse to vacate by the date stipulated an application for eviction may be launched.
4. The application must be served on the occupants informing them of the court date.
5. On the court date the matter will either be heard in the absence of the occupants or postponed for the occupants to obtain legal representation.
Once the matter has been heard on the unopposed roll or opposed roll, the court will then determine a fair and reasonable date by when the occupants are to vacate.
