BAXTER v OCEAN VIEW BODY CORPORATE and Others

Mr Baxter the owner of a Unit in a Sectional Tittle Scheme, won the battle against the increased levies, which were in contravention of 3(1)(c) of the Sectional Titles Schemes Management Act 8 of 2011 (‘the Act’).

We are in this business but some of the costs and increases that are directed to owners / tenants are sometimes very questionable. This judgement should serve as lesson for all stakeholders in property space.
