One of the common questions in a South African property sale is: Who chooses the Conveyancing Attorney? The answer is the seller. The seller has the right to nominate the transfer attorney (also known as the conveyancer) who will handle the transfer of ownership.

Although the buyer is responsible for paying the transfer costs, the appointment of the conveyancer remains the seller’s choice. Understanding why this is the case helps both parties navigate the process with clarity.

The seller has a strong interest in ensuring that the transfer is handled efficiently, as the sale proceeds are only paid out once the registration process is complete. Choosing an experienced conveyancer can help avoid unnecessary delays and ensure that the process moves forward smoothly.

If the buyer is financing the purchase, their bank will appoint a Bond Attorney to register the mortgage bond.
