Why is it important to have a valid Will?

Ons Raak Formeel | “Restitutio in Integrum”

Hierdie regsremedie kom uit die Romeinse reg. Dit beteken letterlik “herstel na die oorspronklike toestand”. Restitutio in integrum het ten doel om mense, sover moontlik, in die posisie te herstel waarin hulle sou gewees het indien 'n onregmatige daad of transaksie nie plaasgevind het nie.

Wanneer 'n kontrak dus herroep of gekanselleer word, is die doel om beide partye terug te plaas in die posisie waarin hulle was, voordat die kontrak gesluit was. As 'n verkoper byvoorbeeld 'n gebrekkige motor aan jou verkoop het en die hof verklaar die kontrak nietig, sou die verkoper jou geld aan jou moes terugbetaal en jy sou die motor weer aan die verkoper moes teruggee.
