Rental Realities - Are You Still Allowed to Prospect?
Presenters: Shaun Luyt and Ismaiel Mohamed

Are You Still Allowed to Prospect?

CPA, POPIA & the direct marketing rules that changed in April.

The rules changed quietly. The risk did not.

If your agency cold calls prospective landlords, sends unsolicited emails, runs WhatsApp broadcast lists, or uses SMS campaigns — the rules changed on 15 April 2026.

New regulations under the Consumer Protection Act introduced a national opt-out registry, mandatory registration for direct marketers, monthly database cleansing obligations, and penalties of up to R1 million or 10% of annual turnover for non-compliance.
This is not just a POPIA issue. The CPA and POPIA are two separate legal frameworks. Compliance with one does not automatically mean compliance with the other.
