Understanding the Conveyancer’s Role in Property Transfers

In South Africa, it’s long been standard practice that the seller appoints the conveyancer, while the purchaser pays the transfer costs.

At first glance, this can feel a bit like being invited to dinner and then receiving the bill - but there’s actually a practical reason behind it. 😄

📌 Why does the seller appoint the conveyancer?
The property being sold is the seller’s asset. By appointing the conveyancer, the seller ensures that the legal transfer of ownership is handled correctly, that timelines are met, and that the purchaser fulfils their obligations under the agreement.

Think of the conveyancer as the referee of the property game - making sure everyone plays by the rules and that the final whistle (transfer) happens smoothly.

📌 Why does the purchaser pay the transfer costs?
When buying property, the purchaser is not only paying for the property itself but also the legal process required to secure ownership. These costs typically include:
✔️ Transfer duty payable to SARS
✔️ Deeds Office disbursements
✔️ Conveyancing fees (based on the value of the property)

In simple terms: the seller provides the property, and the buyer pays the costs to officially make it theirs.

⚖️ But who does the conveyancer actually work for?
This is where it gets interesting. In South Africa, courts have generally recognised that a conveyancer’s duty extends beyond the party who appointed them. Their responsibility is to ensure that both the buyer’s and the seller’s rights are protected during the transaction.

So while the seller may choose the conveyancer, they don’t get to “pick a side.” The conveyancer’s real job is to make sure the deal is legally sound, fair, and properly registered.

🚨 Possession Is Nine-Tenths of the Law (And No, You Can’t Play Sheriff 🤠)

Ever heard the phrase “possession is nine-tenths of the law”? In our legal system, it’s less a proverb and more a bright red stop sign: no DIY justice allowed.

In South African law, spoliation means you can’t unlawfully kick someone out of property they’re peacefully possessing - even if you’re the owner. Yes, really. Ownership takes a back seat here. 🚗💨

If you change the locks, cut off electricity, block access, or tow someone’s car without a court order… the court can order you to restore possession immediately. Arguments about who’s “right” come later.

This powerful remedy - the mandament van spolie - was reinforced in cases like Ivanov v North West Gambling Board and Nino Bonino v De Lange. The message?

👉 No vigilante justice. Not even the Robin Hood kind.
👉 Use the courts.

Even if you’re 100% convinced you’re in the right, taking the law into your own hands can land you in hot water.

The City of Cape Town has released their General Valuation Roll (GRV2025) online and you can check their valuation for your property - this comes into effect on 1 July 2026 and will determine your rates until 2029.

There's a short window for objections.

How do you find your property valuation?

Click on this link: https://web1.capetown.gov.za/web1/gv2025/SearchProperty

Then select ERF from the options on the left, then simply enter your property’s ERF number and click SEARCH.

When you have your property info on screen, you can click on the blue link in the left hand block headed ‘property reference’ and that will give you a number of options including Rates Estimation.
