CONVERTING YOUR GARAGE INTO A LIVING SPACE: SPLUMA PART III
The Spatial Planning and Land Use Management Act (SPLUMA) is a piece of national legislation dealing with TOWN PLANNING, LAND USE AND DEVELOPMENT. It provides that all LOCAL AUTHORITIES may promulgate their own SPLUMA by-laws. To this effect, the CITY OF TSHWANE promulgated their Land Use Management by-law which came into operation in MARCH 2016. The by-laws ensure that all the municipality's town planning scheme is applied uniformly throughout its jurisdiction.
In Tshwane, a SPLUMA CERTIFICATE is REQUIRED whenever a NEW LAND DEVELOPMENT or SECTIONAL TITLE SCHEME stands to be REGISTERED. The purpose of this certificate is to ensure that the property's zoning corresponds with the land use and that all the buildings are in accordance with approved building plans. Unfortunately, a SPLUMA CERTIFICATE is ALSO REQUIRED when an EXTENSION OF A UNIT is contemplated, since NEW SECTIONAL PLANS MUST BE REGISTERED.
When selling a property in MPUMALANGA, a SPLUMA CERTIFICATE must be LODGED FOR ALL TRANSFERS. COMPLYING with the SPLUMA REQUIREMENTS can be a COSTLY and TIME-CONSUMING burden on sellers and should commence as soon as reasonably possible to combat transfer delays.
