We all have a pretty good idea of what a normal levy is and what it is for. It's based on the annual budget and raised at the AGM, and used run the complex and cover costs - to put it very basically.

A special levy occurs when an expense arises that is necessary but not budgeted for, and has been approved by owners at an AGM. Something that is normally outside the expenditure of a complex such as new swimming pool or addition of a clubhouse.

Who is responsible for the repair of water damage or damp?

We see this often-complex problem in many sectional titles today. But it need not be so tricky or tedious. We provide some clarity on the matter.

Such damage often comes from the foundation or outer walls, and also the roof. These are considered common areas, and therefore the body corporate is responsible for the repairs. This also applies if interior water damage comes from a common area such as an outside wall.

It is a different scenario if the leak comes from an overflowing basin or a leaky faucet. Something which is in the control of the owner. The costs are therefore for the owner. In cases where there are multiple floors, the top floor is just as liable for a leak in the ground foundations as the bottom floor is liable for a leak in the roof.

There are also certain scenarios where there has been clear negligence and a water leak or damage or damp has not been reported early and therefore caused more unnecessary and costly damage, and this could end up being for the owners account.

Be vigilant, and report a water leaks asap, regardless of where r it's coming from. There are procedures and protocols and if not done correctly and on-time, it can result in extremely high costs.
