If your home, investment property or family property is registered in a trust, proposed changes to South Africa’s trust laws are worth paying attention to.

Government has published the Regulation of Trusts Bill, 2026, which proposes significantly stronger regulation, transparency and oversight of trusts in South Africa.

It is important to remember that the Regulation of Trusts Bill, 2026 is currently proposed legislation and has not yet become law. The Bill may still change before being enacted.

If you're considering selling or renting a property held in a trust, having the correct documentation in place before beginning the transaction can help prevent unnecessary delays.
