Today: Transfer Costs

TRANSFER COSTS ARE THE TOTAL COSTS involved in transferring ownership of a property into your name. These costs may include conveyancing fees, Deeds Office charges, F**A and administrative costs and, where applicable, transfer duty.

Transfer duty is often confused with transfer costs, but it is only one component of them. A TRANSFER DUTY IS A TAX PAYABLE TO SARS on qualifying property purchases and only applies to properties valued above R1 210 000. If the purchase price falls below that threshold, no transfer duty is payable, although the other transfer costs still apply.

Interestingly, the Afrikaans terms make the distinction clearer: Oordragskoste (transfer costs) and Hereregte (transfer duty).

For many years, the law generally looked to the husband's country of domicile to determine how a couple married overseas was regarded in South Africa. A recent court judgment has changed that position.

Before You Sign | Buying a Property You Haven't Seen

Buying a property without viewing it in person is becoming increasingly common. Virtual tours, photographs and online listings have changed the way many people buy property.

Before you sign an Offer to Purchase, however, take a moment to consider the voetstoots clause. This clause generally records that the buyer accepts the property in its existing condition, having had the opportunity to inspect it before signing.

Where a buyer has not viewed the property, additional clauses are needed to protect both buyer and the seller. Without those provisions, the application of the voetstoots clause can become legally uncertain and may give rise to disputes later.

One of the most common causes of transfer delays relates to obtaining municipal rates clearance certificates for accounts that are billed on estimated consumption. Estimated billing typically occurs where meters are not accessible for municipal readings.

When a property is sold, those estimates must be reconciled against actual usage before clearance figures can be issued, and that reconciliation process can substantially delay registration.

We advise property owners to ensure their meters are accessible, or to submit readings via the municipal app (NMBM Mobile Application on the Google Play Store or Apple App Store) or the NMBM E-Services Portal within five days of receiving their monthly SMS reminder.

Accurate and timely readings reduce the risk of unexpected adjustments during a transfer.
