The DA launched an urgent High Court application to stop the national shutdown planned by the EFF. However, the High Court dismissed the application by the DA but ruled that no school, business, or any roads may be shut down during the protest or so called “national shutdown”. See the court ruling below.

Different Marriage Regimes: Part 3 – Marriage Out of Community With Accrual System

You will need an antenuptial contract.

When the marriage is dissolved the spouse, whose estate shows no or a smaller accrual than the estate of the other spouse, acquires a claim against the estate of the other spouse for half the share of the difference between the accrual of the respective estates of the spouses. Certain assets can be excluded when the antenuptial contract is entered into.

The benefits are the same as those of a marriage out of community of property without the accrual system.

Different Marriage Regimes: Part 2 – Marriage Out of Community Without Accrual System

You will need an antenuptial contract.

The benefits are that each party remains owner of his/ her own estate, and both parties are fully capable to contract individually, and creditors can only attach the contracting party’s assets.

When the marriage is dissolved, each party remains the owner of his/her assets.

Different Marriage Regimes: Part 1 – Marriage in Community of Property

No antenuptial contract is required.

The assets of both husband and wife are joined together into one joint estate, and when the marriage is dissolved, they share equally in the joint estate.

The disadvantage is that both parties’ acting capacity is limited. In case of insolvency creditors attach the assets of both parties. Donation or any inheritance are automatically part of the joint estate.
