So, if you’re keen on buying a home, it’s best to check on any outstanding debts and clear them before you start the process of getting a home loan.

“We are finding that banks are looking closely at bond applicants’ credit scores, and even a small arrears within a 12-month period could count against them, and may result in the bond application being refused,” says Mary Lindemann, Operations Executive of BetterBond.

A recent Eastern Cape High Court Decision (Borcherds v Duxbury) has focused the law on the ever-increasing use of electronic agreements and e-signatures.

Unfortunately, the judgement, instead of giving clarity and guidance, introduces doubt and uncertainty into this fast-growing category of technology.

The benefits and convenience of not having to travel somewhere to sign the document and being able to arrange for the parties to the contract to sign wherever they are in the world at the same time, are very appealing. Of course, the cost and logistics of arranging for original signatures to be couriered around the world can also be dispensed with.

With the prime rate at its lowest level in decades (7%), it’s understandable that more South African tenants may be considering property ownership. Johette Smuts from PayProp says that although real estate is a much desired asset, it is important to remember that home ownership is a long term commitment, often going hand-in-hand with a 20-year mortgage bond that needs to be repaid, while one can safely assume that interest rates will not remain at the current low levels.
